1. Acceptance of Terms
By accessing and using FUNDLI.org (the “Service”), you agree to these Terms of Service (the “Agreement”). These Terms also apply to any posted guidelines or rules applicable to the Service. If you do not agree with any part of this Agreement, you should discontinue using the Service immediately.

2. Description of Service
FUNDLI is a subscription-based toy rental service that allows families to rent, play, and swap toys for children aged 3 and up.
We provide:
Access to a curated collection of high-quality, age-appropriate toys.
Flexible subscription plans for renting and swapping toys.
Convenient home delivery and hassle-free returns.
A sustainable way to enjoy toys without clutter or waste.
FUNDLI does not:
Guarantee specific toy availability at all times.
Sell or permanently transfer ownership of rented toys.
Offer refunds for unused subscription periods.
FUNDLI is not responsible for any damage or injury resulting from toy use. Parents and guardians assume full responsibility for supervising children during play.

3. User Responsibilities
By using this Service, you agree to:

  • Provide accurate and complete information when signing up for FUNDLI.
  • Use the rented toys responsibly and as intended.
  • Return toys in good condition, with normal wear and tear expected.
  • Not resell, distribute, or permanently keep any rented toys.
  • Pay any applicable fees for lost or damaged toys beyond reasonable use.

FUNDLI reserves the right to suspend or cancel any subscription due to misuse or non-compliance with these terms.

4. Account Registration
To access certain features of the Service, you may be required to create an account. By registering, you agree to:

  • Provide true, accurate, and up-to-date information.
  • Update your account information if any changes occur.
  • Keep your login credentials secure and not share your account with others.

FUNDLI reserves the right to suspend or terminate any account found to be in violation of these terms.

5. Privacy Policy
Your use of the Service is subject to our Privacy Policy, which outlines:
How we collect, store, and use your personal data.
Your rights regarding data access and deletion.

6. SMS Terms & Conditions
FUNDLI offers SMS notifications to users who opt in for updates related to toy rentals, subscription reminders, and promotions.

SMS Program Details

  • Purpose: Receive notifications about rental reminders, new toy arrivals, and promotional offers.
  • Message Frequency: Varies based on user interactions.
  • Opt-Out Option: You can unsubscribe at any time by texting “STOP” to the provided number.
  • Help Support: Text “HELP” for assistance or email support@FUNDLI.org.

Message and Data Rates Disclosure (T-Mobile Compliance)

  • Message and Data Rates: Standard rates may apply to each text message sent or received.
  • T-Mobile requires exact language: “message and data rates may apply” or “msg & data rates may apply.”

Important Note:

  • FUNDLI does not conduct official identity verification.
  • Your phone number will only be used for SMS notifications related to the Service and will not be shared with third parties.

7. Carrier Liability & Costs

  • Wireless carriers are not liable for delayed or undelivered messages.
  • Supported carriers include AT&T, Verizon, T-Mobile, Sprint, and others.
  • Msg & data rates may apply.

8. Subscription Fees & Cancellation Policy

  • All subscription fees are charged on a recurring basis.
  • You may cancel your subscription at any time, but no refunds will be issued for partial billing periods.
  • If a subscription is canceled, all rented toys must be returned before the next billing cycle to avoid additional charges.

FUNDLI reserves the right to modify pricing and will provide notice before changes take effect.

9. Lost or Damaged Toys

  • Normal wear and tear are expected, but excessive damage or lost toys may result in replacement fees.
  • If a toy is lost or damaged beyond repair, the subscriber may be charged a replacement fee based on the toy’s retail value.

10. Termination of Service
FUNDLI reserves the right to terminate or restrict access to the Service at any time, with or without notice, if:

  • A user violates any terms in this Agreement.
  • There is suspected fraud or misuse of the platform.
  • A user fails to return rented toys.

11. Arbitration & Class Action Waiver

Arbitration Agreement
Any disputes or claims arising from your use of the Service will be resolved exclusively through binding arbitration, in accordance with the Federal Arbitration Act.
Class Action Waiver
You agree that all dispute resolutions must be conducted on an individual basis. Class actions, consolidated claims, or representative actions are not permitted.
If a claim proceeds in court rather than arbitration, both parties waive the right to a jury trial.

12. Governing Law
This Agreement is governed by the laws of the State of Washington, United States, and applicable federal laws, without regard to conflict of law principles.
